Professional indemnity of medical staff

is a compulsory insurance taken out by medical institutions to cover their medical staff according to Art. 189 of the Health Protection Act of 01.01.2005.

Armeec Insurance JSC covers the professional liability of the insured in respect of:

• Any sums up to the agreed limit of indemnity which the insured shall be legally liable to pay as compensation for bodily injury (including permanent disability) or death of patient(s) as a result of a culpable breach of professional obligations caused by negligence, errors and omissions in the course of any professional services which have been or should have been rendered by the insured and/or his/her qualified employees;
• Any claims settlement expenses made with the consent of the insurer, which are included in the limits agreed under the policy.

The insurance is signed on the basis of a proposal-questionnaire duly completed by the proposer. The policy is issued after payment of the insurance premium which is a fixed sum per insured person depending on the chosen limit of indemnity and the speciality of the insured medical person.

In case of a valid claim the indemnity shall be payable to the insured within 14-days’ period after establishment of its grounds and amount. The indemnity due under the present insurance shall be fixed on the basis of an out-of-court agreement between the insured and the injured party. If such an agreement is not reached, the indemnity will be payable on the basis of an enforced court decision.
